GENERAL PROVISIONS

1. With these General Terms and Conditions, the relations between “EasyRentBulgaria“ EOOD, UIC 202163172, hereinafter referred to for short as “EasyRent”, and Clients arising on the basis of a rental agreement for a vehicle or other items offered by EasyRent are regulated.

2. Correspondence with EasyRent is carried out at the address: Nesebar 8230, Residential Complex Sunny Beach, Karlovo Hotel, ground floor, telephone +359 899 999 179; email address: [email protected] or through another method indicated on EasyRent’s website: https://easyrentbulgaria.bg/.

3. Throughout these General Terms and Conditions, the following words and expressions, when beginning with a capital letter, regardless of whether they are used with an article or in the plural, shall have the meanings specified in this clause:
A) “General Terms and Conditions” – these General Terms and Conditions for concluding rental agreements for a vehicle (car) or other items offered by EasyRent.
B) “Individual Agreement” means a rental agreement for the vehicle and/or other items (equipment), concluded between EasyRent and the Client. These General Terms and Conditions are an integral part of every Individual Agreement. In the event of any contradiction between the Individual Agreement and the General Terms and Conditions, the Individual Agreement shall prevail.
C) “Client” – a natural person who wishes to use and/or requests and/or concludes a rental agreement for a vehicle or other items offered by EasyRent.
D) “Driver” – a natural person who will operate the rented vehicle. When the Driver is a person different from the Client, the respective data of the Driver is recorded in the Individual Rental Agreement. Only one additional Driver may be entered in the agreement. All obligations of the Client under the General Terms and Conditions and the Individual Agreement are also deemed to be obligations of the Driver.
E) “International Driving Permit” – a driving licence or another document certifying the right to operate a motor vehicle, which by virtue of international treaties in force for the Republic of Bulgaria gives the Client the right to drive the vehicle on the territory of the country and on the territory of the respective state in which the use of the rented vehicle is permitted in accordance with the General Terms and Conditions.
F) “Vehicle Classes” – categorisation of individual vehicles according to their technical characteristics, quality and standards. The individual vehicle classes are economy, compact, station wagon and minivan, luxury and SUVs, and the classification of the separate makes and models of vehicles into the respective class is indicated on EasyRent’s website.
G) “Equivalent Class Vehicle” – a vehicle of the same class, with identical or similar size, identical number of doors and identical number of seats.
H) “Rental Price” – the price for renting the respective vehicle for a period of 24 hours, which is indicated in EasyRent’s Price List or published on EasyRent’s website, or specified in the rental agreement;
I) “Fee” – an additional amount, different from the Rental Price, which is paid by the Client for the provision of an additional service or the performance of additional actions by EasyRent in accordance with the General Terms and Conditions, the Individual Agreement and the Price List.
J) “Full Coverage Fee” – an amount determined depending on the class of the vehicle, in accordance with EasyRent’s Price List, by paying which the Client benefits from the additional services provided in these General Terms and Conditions.
K) “Price List” – a list of the additional services provided by EasyRent, indicating the prices/fees for them.

REQUIREMENTS TO THE CUSTOMER AND HIS/HER DOCUMENTS

4. The Client must possess and present to EasyRent:
A driving licence for the respective vehicle category, valid for a period not shorter than one month after the end of the rental period of the vehicle;
A functioning credit card with an embossed number, valid for at least one year after the end of the rental period — with an available (unused) limit not smaller than the amount of the deposit;
A current residential address;
Drivers who are citizens of a country outside the European Union must present an international driving permit.

5. The Client is obliged to present identity documents (identity card or passport) with a minimum validity of not less than one month after the end of the rental period of the vehicle.

6. The minimum age for renting a vehicle without additional charges is 25 years for economy, compact, station wagon and minivan vehicles, and 30 years for “luxury class” and SUVs.

7. Clients aged between 18 and 25, as well as over 65 years old, and with driving experience of less than 3 years, pay additionally:
(a) a “Young Driver” fee of EUR 10.00 for each rental day;
(b) a “Full Coverage” fee, determined according to the type of vehicle;
(c) a double-sized deposit, determined according to the type of vehicle.

8. The Client must possess at least 1 year of driving experience when renting “economy, compact, station wagon and minivan” vehicle classes, and 5 years of experience for “luxury class” and SUVs.

9. EasyRent reserves the right to refuse a reservation or the provision of a vehicle in the event that any of the documents presented by the Client does not meet the requirements of the General Terms and Conditions or is damaged/invalid.

CAR BOOKING. EXTENSION OF THE CAR RENTAL PERIOD

10. The Client may reserve a vehicle through the online platform on the EasyRent website; through an online rent-a-car platform on which EasyRent offers its services; by phone request; or at a company office. In the case of an online reservation, it shall be considered confirmed after EasyRent receives an electronic confirmation of payment or upon the occurrence of the confirmation conditions under the General Terms and Conditions / the policy of the respective platform.

11. In the case of a reservation made at an EasyRent office or upon receiving the vehicle under an online reservation, the Client must conclude an individual rental agreement, which determines the conditions for renting the vehicle – type of vehicle, registration number, rental period, rental price, vehicle condition, rental of other items (equipment) and other matters. The General Terms and Conditions form an integral part of each individual rental agreement.

12. The minimum rental period for a vehicle is 24 hours. The vehicle may be provided for a shorter period only with the prior approval of EasyRent, in which case the Client shall owe a rental price equal to the price for the minimum period. The same rule applies when extending the rental period by less than 24 hours.

13. The rental period may be extended through the online platform on the company’s website or at an EasyRent office, no later than one day before the end of the rental period under the individual agreement. The extension may be done by marking it on the individual agreement, by signing an annex to it, or by concluding a new agreement. The price for the extended period depends on the duration of the extension according to the valid Price List on the payment date, and the “Full Coverage” fee is always charged.

14. When the extension of the rental period includes using the vehicle in another country, the Client shall pay a fee of EUR 20.00 for extending the validity of the authorization for driving abroad by up to 7 days. For an extension of more than 7 days, the Client shall also pay all fees and expenses for issuing a new authorization for driving abroad, as well as a new cross-border fee in accordance with the Price List.

15. If EasyRent consents to extending the rental period, the Client must pay the new rental price and all additional fees on the same day. The deposit cannot be used to cover the rental price for the extended period, as the full deposit amount must remain in place for the entire duration of the rental agreement. After the payment is made, the necessary documents will be left at the respective office for collection. The Client must visit the office to receive/sign the documents. EasyRent is not responsible for any consequences if the Client fails to collect the new documents.

16. EasyRent reserves the right to refuse the extension of the rental period, in which case the Client must return the vehicle in accordance with the agreement and the General Terms and Conditions.

CANCELLATION OF BOOKING

17. A confirmed and paid reservation may be changed/cancelled free of charge up to 48 hours before the scheduled pick-up time of the vehicle. When the reservation is made through the online platform on the EasyRent website, the reservation fee is refunded to the Client within up to 20 business days.

17.1. In case of cancellation between the 48th and 24th hour before the scheduled pick-up time, when the reservation is made through the online platform on the EasyRent website, the prepaid fee may be added to the Client’s wallet in their profile on the website and may be used for a future reservation without time limitation. For the period during which the amount remains in the Client’s virtual wallet, EasyRent does not owe interest, compensation or any other reimbursement. The amounts in the wallet are not subject to cash withdrawal.

18. In case of cancellation up to 24 hours before the scheduled pick-up time of the vehicle, the prepaid reservation amount is non-refundable.

18.1. If the Client does not appear within 1 hour after the scheduled pick-up time without prior notice of delay, the reservation is considered cancelled, and all prepaid amounts are non-refundable.

19. If the reservation is made through another online rent-a-car platform on which EasyRent offers its services, the cancellation and refund terms follow the General Terms/Policy of the respective platform.

20. EasyRent reserves the right to refuse a confirmed reservation if it is unable to provide the booked vehicle or another vehicle of an equivalent class; in such a case, the amount paid by the Client will be fully refunded. EasyRent does not owe any compensation to the Client.

21. In addition to the cases provided in these Terms, EasyRent reserves the right to refuse to provide a vehicle in case of inappropriate and/or inadequate behavior of the Client, or when there is reasonable cause to assume that the Client will not be able to fulfill the contract. In this case, the reservation fee is refunded to the Client unless otherwise provided in the General Terms.

RECEIVING THE VEHICLE AND ITS RETURN

22. The vehicle is delivered in proper technical condition, together with the equipment required by law or additionally paid for by the Client. The condition of the vehicle and the respective equipment is recorded in the Individual Rental Agreement at the time of pick-up in the mandatory presence of the Client. By signing the agreement, the Client agrees with all damages marked in their presence at the time of vehicle pick-up.

23. EasyRent offices at Sofia Airport, Varna Airport and Burgas Airport operate 24/7. Vehicle pick-up and drop-off at these offices is possible at any time; however, for service within the time period from 21:00 to 08:00, an additional "out-of-hours service fee" of 25 EUR is charged for each separate action – pick-up and/or drop-off of the vehicle. This fee is not included in the rental price and is payable on site upon vehicle pick-up.

Example (out-of-hours service): If the Renter picks up the vehicle at 23:00 and returns it at 05:00, two out-of-hours service fees will be charged, for a total amount of 50 EUR.

23.1. Official public holidays: For reservations serviced on days officially declared as public holidays in the Republic of Bulgaria, an additional fee of 25 EUR is charged for each separate action – pick-up and/or drop-off of the vehicle, regardless of the time of service. This fee is not included in the rental price and is payable on site upon vehicle pick-up. The fee is related to providing staff for work during public holidays and is separate from the out-of-hours service fee.

Example (combined scenario – out-of-hours service and public holiday): If the Renter picks up the vehicle at 22:00 on a public holiday and returns it at 07:00 on the following day, which is also a public holiday, a total of four fees will be charged – two out-of-hours service fees and two public holiday fees, amounting to a total of 100 EUR.

24. The working hours of the other EasyRent offices are indicated on the company's website and displayed at the respective office locations. Vehicle pick-up and drop-off are carried out within the specified working hours for these offices. In case of a request for service outside these working hours, an additional fee of 25 EUR is charged for each separate action – pick-up and/or drop-off of the vehicle. This fee is not included in the rental price and is payable on site.

25. EasyRent does not operate offices outside the territory of the country and does not use offices of other companies providing the same services.

26. EasyRent reserves the right to provide a different make and model of vehicle from the originally reserved one, from an equivalent class. If the reserved vehicle is not available at pick-up time and no other equivalent vehicle is available, EasyRent may offer the Client a vehicle from a higher class without additional charge. If the Client does not agree to the replacement under the previous sentences, the prepaid amount is not refunded.

27. EasyRent may provide a replacement vehicle in case of a malfunction caused by a technical defect or wear of a component. The replacement is carried out at the nearest EasyRent office. If the vehicle cannot be driven, the replacement is performed at the location of the defective vehicle, and the costs of the replacement are borne by EasyRent. If the malfunction is the result of the Client's actions or omissions, the Client must cover all replacement and repair costs.

28. The paid reservation fee is non-refundable, and the reserved vehicle is released from reservation:
A) when the Client does not appear at the designated pick-up location within one hour after the scheduled pick-up time, without notifying EasyRent in advance or without providing a flight number;
B) when the Client has not cancelled the reservation within the deadlines set in the General Terms and Conditions;
C) when the Client fails to provide any of the documents required under the General Terms or any of them is damaged or invalid;
D) when the Client refuses to pay the rental price and/or the deposit and/or the additional items (equipment) and/or additional requested services upon signing the agreement or within the required deadline;
E) in other cases provided in the General Terms.

29. When the vehicle is returned earlier than the date specified in the contract at the Client's request, EasyRent does not refund the amount for the unused rental period.

30. If the Client is provided with tickets and/or access cards for airport parking areas, they must be used solely for exiting the parking lot upon vehicle pick-up. Staying on the parking lots longer than necessary to exit is prohibited. If the Client violates this rule and EasyRent must pay fees or compensation for the extra parking time, the Client must reimburse the full amount.

31. The vehicle must be returned to the same EasyRent office from which it was picked up. Return to another office is possible only upon a request made by the Client no later than 24 hours before the final return date, subject to EasyRent's approval and payment of a one-way rental fee according to the Price List. EasyRent reserves the right to refuse a return to an office different from the one of pick-up.

32. If the vehicle must be returned to a parking area, it must be parked only at spaces designated for EasyRent or indicated by an EasyRent employee. If the Client violates this requirement and EasyRent is charged a fee or penalty for improper/unauthorized parking, the Client must reimburse the respective paid amounts.

33. The Renter is obliged to return the vehicle in the same condition and with the same equipment as it was delivered. In case any discrepancies are identified, the Renter shall compensate EasyRent for all damages caused to the vehicle. The Renter's refusal to sign the report establishing such discrepancies upon return of the vehicle shall be certified by the signature of one witness. In such case, the findings stated in the report shall be binding for the Renter. The same consequences shall apply if the Renter is not present or refuses to be present during the vehicle inspection upon return, unless there are valid reasons for this.

33.1. For rentals of 1 to 5 days inclusive, the Renter must return the vehicle clean and washed (inside and out). Failure to comply with this requirement will result in a cleaning fee of EUR 25.00 being charged by EasyRent.

33.2. For reservations without the optional "Full Coverage Fee", regardless of the rental duration, the Renter shall be charged a vehicle preparation fee of EUR 25.00.

34. The Client must return the vehicle with the same amount of fuel as at pick-up. If returned with less fuel, the Client owes a service fee of EUR 15.00 and pays the missing fuel at EUR 1.70 per liter. If returned with more fuel, EasyRent does not refund the excess.

35. The Client must return the vehicle only to an authorized EasyRent employee; otherwise, they bear full responsibility equal to the insurance value of the vehicle.

REQUIREMENTS FOR THE USE OF THE VEHICLE. USE OF THE CAR OUTSIDE THE TERRITORY OF THE REPUBLIC OF BULGARIA

36. The Client must exercise due care when using the vehicle; must drive in a fit condition and must not be under the influence of alcohol, narcotics or other substances that limit or exclude their ability to drive or fulfil their obligations under Bulgarian law and these General Terms, and must comply with all traffic regulations applicable in the Republic of Bulgaria or in other countries where the rented vehicle is used.

37. The rented vehicle may be used on the territory of the Republic of Bulgaria or on the territory of other countries as provided herein.

38. The vehicle may be driven outside the country only after a prior request by the Client and approval by EasyRent, and simultaneously complying with the following conditions:
A) the minimum rental period for international travel is 7 days;
B) providing information at least 3 days before pick-up about the countries the Client intends to visit;
C) paying a one-time fee between EUR 75.00 and EUR 100.00 for one country, and EUR 35.00 for each additional country;
D) paying a triple-sized deposit by credit card depending on the vehicle class;
E) paying the “Full Coverage” fee.

39. For any attempt to leave the country without explicit permission from EasyRent, the Client owes a penalty equal to the deposit, and EasyRent reserves the right to terminate the contract. In case of termination, the paid amount for the full rental period is deemed a penalty and is not refundable.

40. When a 4G Wi-Fi device is requested and the vehicle is driven outside Bulgaria, the use of the mobile device is prohibited. In case of violation, the Client must reimburse EasyRent for all additional mobile communication charges billed by the mobile operator.

41. Smoking, consumption of alcoholic beverages and/or narcotic, intoxicating or other prohibited substances, as well as driving during or after consumption of alcohol or narcotics, and transporting pets in the rented vehicle, are strictly prohibited. In case of violation, the Client owes a penalty equal to the deposit.

42. EasyRent provides the vehicle washed, and for rentals under 48 hours it must be returned in the same condition. When the vehicle is returned heavily soiled (upholstery, sand, mud, etc.), the Client pays a cleaning fee of EUR 100.00.

43. It is prohibited to use the rented vehicle for competitions or training; for towing another vehicle or trailer; for transporting any cargo; and for driving on roads outside the national road network or on unpaved roads, regardless of purpose. In case of violation, the Client owes a penalty equal to the deposit.

44. In case of an incident, traffic accident, any damage to the Vehicle, forced seizure or impounding of the Vehicle by authorities, suspension from traffic or revocation of registration, theft, or any other event affecting the Vehicle and limiting or preventing its intended use, regardless of cause or fault, the Client must immediately notify EasyRent and remain at the location, wait for law enforcement and obtain a protocol or other document for the incident. The Client must report all facts, circumstances and data (names of witnesses, etc.) and fully cooperate with the Police/Traffic Police for issuing the official document.
44.1. The Client must take all necessary actions to save, limit and/or reduce the damages to the Vehicle.
44.2. The Client must, at their own expense and responsibility, obtain all other documents required by the Lessor in relation to the event and submit them within 3 days from the event, and must make the Vehicle available for inspection and photos no later than the 3rd day after the event at a location indicated by the Lessor.
44.3. The Client must assist the Lessor in clarifying the event and determining the damages suffered, including by answering inquiries, providing information and documents, and offering reasonable assistance in pre-trial and court proceedings. Incorrectly completed documents or documents submitted outside the deadlines are considered as non-submitted.
44.4. If the incident/violation is caused by the Client and as a result the vehicle cannot be used for EasyRent’s commercial activities, the Client owes a penalty equal to the rental price for the entire period during which the vehicle cannot be used, as well as reimbursement of all additional costs resulting from the event, accident or violation.

45. The Client is not allowed to perform repairs except with explicit approval from EasyRent.

46. In case of a flat tyre, the Client must repair it at their own expense or purchase a set of two new tyres at their own expense.

47. The Client must monitor oil and coolant levels throughout the rental period and, if needed, purchase and refill the necessary fluids.

DELAY IN RETURNING THE VEHICLE

49. The Client undertakes to return the vehicle on the agreed date and time, and to the office where it was received, or to another office in accordance with these General Terms.

50. In case of a delay in returning the vehicle of up to 6 hours, the Client owes a rental fee for one day.

51. In case of a delay in returning the vehicle of more than 6 hours, the Client owes a rental fee equal to the daily rate under the Individual Agreement plus 20% of that amount. If the delay lasts more than one day (24 hours), the price under the previous sentence is due for each commenced 24-hour period until the vehicle is returned.

52. If the vehicle is not returned within 72 hours, EasyRent will notify the competent authorities to declare the vehicle wanted. In case such a request is submitted, the Client owes a fee of EUR 50.00 in addition to the amounts due under the previous provisions.

PAYMENT OF AMOUNTS. BLOCKING AND RELEASING AMOUNTS

53. The Client is obliged to pay the amounts provided herein, in the Individual Agreement or in the Price List (rental price, fees, penalties and others) when the respective grounds arise.

54. The Price List is published on the EasyRent website, as well as visibly displayed in the company’s offices. By confirming/signing the General Terms or by signing the Individual Agreement, the Client confirms that they are familiar with the Price List.

55. All amounts become due (payable) on the day on which the respective obligation arises, unless otherwise agreed or provided in these General Terms. In case of delay, the penalties and/or compensations provided herein and/or due under Bulgarian law shall be owed, without the need for sending a payment notice to the Client.

56. When reserving a vehicle through the online platform on the EasyRent website or through an online car-rental platform where EasyRent offers its services, the Client pays a reservation fee in the amounts defined on the respective platform.

57. Upon receiving the vehicle, the Client must pay the rental price for the rental period, the deposit, and all additional services requested by the Client that are not included in the rental price. If a reservation fee has been paid, it is deducted from the rental price.

58. The rental price includes unlimited mileage per day, compulsory Third-Party Liability insurance, local vehicle tax and vignette. The rental price does not include fuel and other amounts owed in relation to the use of the vehicle, including fines and penalties.

59. Payment of the amounts due may be made by credit card or bank transfer. All EasyRent offices have POS terminals for cashless payment. Payment in cash or by debit card is possible only with the consent of EasyRent and if allowed by the online reservation platforms. Cash payments are allowed only in compliance with legal restrictions.

60. Online reservations may be paid by credit/debit card (Visa/MasterCard), PayPal or bank transfer.

61. If the Client requests a change to a lower-class vehicle than the one reserved, the difference in price is not refunded.

62. The deposit is paid by credit card (Visa or MasterCard) issued in the Client’s name, and it serves as a guarantee for fulfilling contractual obligations. The deposit amount depends on the vehicle class and varies between EUR 200.00 and EUR 2,000.00. If the Client does not wish to use the “Full Coverage” service, the deposit will be tripled.

63. In case of a lost key, lost documents, missing parts, etc., due to the Client’s fault, the Client owes payment of all costs for their restoration.

64. The deposit is released (unblocked) after a full inspection of the returned vehicle and if no violations are found, within 20 business days of returning the vehicle. If the authorization slip is lost or not provided, EasyRent will file a request with the bank for the release of the amount, for which the Client owes a fee of EUR 10.00. Release timelines are determined by the relevant bank, with a minimum processing period of 30 business days.

65. Deposits in cash or by debit card are allowed only if the Client has paid the “Full Coverage” fee. EasyRent reserves the right to refuse a cash/debit-card deposit and to refuse to provide the vehicle, and this will not be considered a breach by EasyRent.

66. The deposit is refundable upon returning the vehicle if the Client does not owe any amounts, regardless of their grounds, that should be covered by the deposit under these General Terms.

67. By signing/agreeing to these General Terms, the Client gives irrevocable and unconditional consent:
A) for the deposit to be used to cover amounts owed under these Terms and the Individual Agreement. The deposit or part of it will be retained on the day the respective amount becomes due. If the deposit cannot cover all due amounts, the Client gives irrevocable consent for EasyRent to charge the provided credit card.
B) for EasyRent to charge amounts (including direct debit) to the debit/credit card to cover any obligations arising during the rental period, even if such obligations become due after the end of the rental agreement.

68. Transactions are processed via MasterCard Identity Check and VISA Secure security programs.

69. For security reasons, the maximum card payment amount is 10,000 BGN.

70. We do not store bank-card data used for payments through the website.

71. If a refund is required for an amount paid by bank card, the sum will be returned to the card used for the payment.

“FULL COVERAGE” FEE

72. Payment of this additional fee grants the Client the following rights:
A) refund of the deposit in case of damage or theft;
B) a replacement vehicle in case of damage, fire or theft, delivered to an address specified by the Client;
C) free roadside assistance in case of damage or fire within the territory of the country;
D) 24/7 customer service and support from the EasyRent call center;
E) exemption from payment of an administrative fee in case of an incident or road traffic accident.

73. The Client may use the above rights only if the following conditions are met:
A) in the event of an incident, damage or road traffic accident, the Client must present to EasyRent a police report within one business day of the event;
B) in the event of theft/fire or total loss, the Client must provide EasyRent with all required documents from the Traffic Police (KAT);
C) the Client must comply with the traffic rules of the Republic of Bulgaria and the country where the vehicle is being used, including but not limited to driving without alcohol or drugs, adapting driving to road conditions and not exceeding speed limits;
D) the Client must not allow any person other than the one(s) listed in the Individual Agreement to drive the vehicle.

74. The “Full Coverage” service does not release the Client from liability to compensate EasyRent for:
A) damage to the interior of the vehicle (upholstery, dashboard, seats, lining, etc.), as well as damages to wheels, rims, tires and windows;
B) lost documents, keys or vehicle license plate;
C) missing parts in the vehicle such as CD player, lighters, rims, GPS navigation unit, 4G Wi-Fi device, headlights, antenna, etc.;
D) vandalism caused by items forgotten or left by the Client inside the vehicle;
E) a discharged battery and a soft or flat tire;
F) any damages — regardless of their size — caused intentionally or through gross negligence by the Client;
G) EasyRent does not provide a replacement vehicle if the Client has not paid for the “Full Coverage” service.

LIABILITY. PENALTIES

75. EasyRent is not liable in cases where incorrect information is provided by the companies operating the rental-car platforms through which EasyRent offers its services.

76. EasyRent is not liable for the (in)actions of credit institutions/banks regarding the (un)blocking of due amounts, which may result in or have resulted in the Client being unable to use the blocked sum and/or the credit card, regardless of the duration of the delay.

77. The Client must use the rented vehicle according to its purpose and maintain it in the technical condition in which it was delivered, in accordance with the General Terms, the Individual Agreement and Bulgarian legislation. In case of any violation, the Client owes the corresponding fee and/or penalty specified in the General Terms and/or the Individual Agreement. If no such penalty is agreed or the penalty cannot cover the full amount of damages, the Client owes payment of the respective/full amount of compensation.

78. EasyRent reserves the right to regain possession/control of the vehicle without prior notice to the Client if the vehicle is used in violation of the General Terms, the Individual Agreement, Bulgarian law, or the law of the country where use of the vehicle is permitted, as well as in cases where the Client fails to fulfill their obligations. In these cases, EasyRent does not owe any refund for the remainder of the rental period.

79. The Client owes full compensation for damages resulting from (a) the use of poor-quality fuel, oil or other consumables, or consumables incorrectly filled/added by the Client, or (b) filling fuel that does not correspond to the type and specifications of the vehicle. If such damages occur and cause engine blockage, for which the Client is liable, then:
A) if the engine can be replaced or the replacement does not exceed the insurance value of the vehicle, the Client owes compensation equal to the cost of the replacement;
B) if the engine cannot be replaced or the replacement would cost more than the insurance value of the vehicle, the Client owes compensation equal to the insurance value of the vehicle.

80. If a parking access ticket and/or access card used by EasyRent for vehicle pickup and return is lost, the Client must pay a penalty of EUR 50.00.

81. All fines, fees, other sanctions and expenses paid by EasyRent due to violations of the law committed by the Client while using the rented vehicle shall be reimbursed by the Client. The amounts are due within three days from the Client being notified about the payment obligation. An administrative fee of EUR 55 applies for each violation.

82. If the use of the vehicle becomes impossible as a result of the Client's (in)actions, regardless of whether they constitute a violation/crime, the Client owes the rental price under the Individual Agreement for the entire period during which the vehicle cannot be used.

83. Transporting illegally residing foreigners, as well as pets, in the rented vehicle is strictly prohibited. In case of violation, the Client owes a penalty equal to the deposit.

84. If the rented vehicle is destroyed or stolen and the Client fails to fulfill a legal obligation or an obligation under the General Terms and/or loses the vehicle keys and/or a document necessary for filing an insurance claim, resulting in the insurer refusing to pay compensation, the Client owes compensation equal to the insurance value of the vehicle. The same applies if the keys and/or documents are left unattended, whether inside or outside the vehicle.

84. The Client may bear limited liability (up to a specific amount) only if this is provided for by the respective rental-car platform, the Client has paid the corresponding fee (if applicable), or EasyRent has agreed to such limited liability.

85. In the event of a new damage (excluding theft/total loss), the Client may have limited liability (up to an “excess” amount) only if this is provided for on the rental-car platform through which the Client reserved the vehicle, or if EasyRent has agreed to such limitation.

86. The Client and the Driver are jointly and severally liable for all obligations under these General Terms and the Individual Agreement, for all compensations for damages, and for all additional legal or extrajudicial expenses (state fees, postal/courier fees, expert reports, enforcement fees, legal fees, etc.) that EasyRent pays in order to enforce the liability of the joint debtors and recover due and unpaid amounts.

PROTECTION OF PERSONAL DATA

87. In connection with the application of these General Terms and the performance of the services provided by EasyRent, as well as in connection with the conclusion and execution of the Individual Agreement, EasyRent processes certain categories of personal data of the Client, as well as possibly of third parties indicated by the Client in relation to the conclusion and execution of the Individual Agreement. These categories of personal data are detailed in EasyRent’s Privacy Policy, available on the website at: https://easyrentbulgaria.bg/informaciq/politika-za-zashtita-na-lichnite-danni.

88. In its capacity as a personal data controller, EasyRent processes the respective personal data for purposes, on legal grounds and within time periods detailed in the Privacy Policy referred to in the previous clause. This Privacy Policy also contains information regarding the rights the Client has in connection with the processing of their personal data by EasyRent.

89. The Client has the right at any time to request and receive from EasyRent a paper copy of the Privacy Policy under item 1 above. By accepting these General Terms, the Client confirms that they are familiar with the content of this Policy.

ADDITIONAL PROVISIONS

90. The General Terms become binding for the Renter after completing the online reservation, in which they have checked the box for accepting them, as well as upon accepting them when making a reservation at an EasyRent office. Acceptance in the latter case is certified by the Renter’s signature.

91. The Parties expressly agree that these General Terms, the Rental Agreement, any supplements and amendments thereto, and any other documents that arise from and/or are related to the General Terms and the Rental Agreement may be signed in one of the following ways:

91.1. With a handwritten signature on paper.

91.2. With a simple electronic signature or an advanced electronic signature within the meaning of Art. 3, items 10 and 11 of Regulation (EU) No 910/2014 of the European Parliament and of the Council of 23 July 2014 on electronic identification and trust services for electronic transactions in the internal market and repealing Directive 1999/93/EC, in the form of electronic data (a signature written with a stylus on a tablet or other similar electronic device), which the holder of the electronic signature uses to sign, added to or logically linked with these General Terms, the Rental Agreement, supplements and amendments thereto, and any other related documents when the same are in electronic form.

91.3. The Parties expressly agree that the legal force of the simple and advanced electronic signatures under Art. 89.2 above shall be equivalent to that of handwritten signatures in accordance with Art. 13, para. 4 of the Electronic Document and Electronic Trust Services Act and Art. 25, para. 1 of Regulation (EU) No 910/2014 of the European Parliament and of the Council of 23 July 2014.

91.4. Additionally, the Parties expressly confirm and agree that these General Terms, the Rental Agreement, supplements and amendments thereto, and any other documents governing the relationship between the Parties, when signed with a simple or advanced electronic signature, shall be considered to be made in writing and shall constitute original documents.

91.5. The Parties undertake not to dispute the admissibility, enforceability or evidential value of such documents solely on the grounds of their electronic form or electronic signature.

91.6. The Rental Agreement and these General Terms constitute the entire agreement regulating the relations between the Lessor and the Renter in connection with the rental of the Vehicle.

92. The Rental Agreement and the General Terms are governed by the law of the Republic of Bulgaria.

93. All disputes regarding the validity and execution of the Rental Agreement shall be resolved by agreement, and if impossible – by the competent court. In the event of a dispute, the Bulgarian-language version of the Rental Agreement and the General Terms shall prevail. Documents received through electronic or other communication, including via the Internet, shall be accepted as written evidence.

94. EasyRent reserves the right to amend and supplement these General Terms at any time, with the new General Terms and the date of their entry into force being published on the EasyRent website. EasyRent notifies the Renter of the publication of the amended General Terms by email or SMS.

95. Correspondence between EasyRent and the Renter shall be conducted in writing at the addresses and by the methods specified in these terms and the individual contract. Written form shall be deemed observed even if the notice is sent by fax or email. If the notice is received or enters the system after 17:00 Bulgarian time, it shall be considered received on the next business day. If either Party changes any of the addresses or correspondence methods, they must notify the other Party immediately. If they fail to do so, the notice shall be considered duly delivered if sent using any of the methods or to the addresses specified in these terms and the individual contract.

96. For any matters and disputes not expressly regulated and arising in connection with the conclusion, execution, non-performance, or interpretation of the individual contract and the General Terms, the legislation of the Republic of Bulgaria shall apply.

97. Disputes shall be submitted for resolution before the competent Bulgarian court under the rules of the Civil Procedure Code (CPC).
